A potential solution for "ways out" of pvp

I've got an idea that may substantially help out with player retention...im a solo/small group player with ~2000 hours in game and for me, one of the most aggravating things about traversing the world is when a larger group starts approaching you, especially near town, and you have no idea if they are friendly or not. What do you do? You fear taking the first shot, because then you go red and can't enter town. If you dont start shooting first, it's usually the case that they are on an unarmored mount so they catch you and then earthquake you off your horse. Two solutions:
1. Don't make pvp "opt in" but make being a criminal opt in. Example: if I want to kill a blue, I have to flag for being criminal, which then turns me red with a 15 sec cooldown before I can do damage or unflag. Within that 15 second cooldown , however, players can start attacking me with no penalty. Also, if damage is taken during criminal status, it adds time to the cooldown for me to unflag.
2. Make the EQ dismount function have a damage threshold
